End User Limited Warranty Statement

Cubix Corporation LLC (Cubix) warrants all non-software products to be free from defects in materials or workmanship under normal use for a period of 3 years from date of shipment from Cubix, *except for certain components and peripherals that are warranted by the original manufacturer for a period of less than 3 years. In these cases Cubix will warrant these devices according to the terms and conditions defined by the original manufacturer. A list of these devices and their corresponding warranty terms is included at the end of this statement.  During the warranty period, Cubix will repair or replace defective parts that are returned to Cubix. Replacement parts may be new or refurbished. Replacement parts are warranted for the remainder of the warranty period or 90 days whichever is longer. All parts that are exchanged under this warranty become the property of Cubix. The warranty does not include on-site repair charges such as labor, travel, shipping or other expenses associated with the repair or installation of replacement parts. Cubix is not responsible for damage to or loss of any programs, data, or removable storage media.

Cubix strongly recommends that the End User register the system with Cubix Customer Service. Registration will expedite subsequent service and permit Cubix to advise the user of future updates and service bulletins.

This warranty extends only to the Original Purchaser or Registered End User. This warranty may be transferred to subsequent end users upon request of the original end user. Contact Cubix Customer Service to transfer the warranty.

This warranty excludes products which have been damaged or rendered defective due to external causes including but not limited to:

Cubix warranty obligations with respect to software distributed by Cubix are stated in the applicable end user license agreement, which is included with the software. Cubix Corporation is not obligated to repair or replace software under this Limited Warranty.

EXCEPT AS EXPRESSLY STATED IN THIS WARRANTY, CUBIX MAKES NO OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CUBIX EXPRESSLY DISCLAIMS ALL WARRANTIES NOT STATED IN THIS LIMITED WARRANTY.

CUBIX CORPORATION’S RESPONSIBILITY FOR DEFECTS AND MALFUNCTIONS OF THE COMPUTER HARDWARE IS LIMITED TO THE REPAIR AND/OR REPLACEMENT OF THE FAULTY COMPONENTS, AS SET FORTH IN THIS WARRANTY STATEMENT. CUBIX IS NOT LIABLE FOR ANY DAMAGES CAUSED BY THE CUBIX COMPUTER SYSTEM OR THE FAILURE OF THE COMPUTER TO PERFORM, INCLUDING ANY LOST PROFITS, LOST SAVINGS, INCIDENTAL DAMAGES, OR CONSEQUENTIAL DAMAGES .

Cubix urges all users to complete the warranty registration procedure: to insure prompt service in the event of system failure. Products purchased through re-sellers should be registered to establish the correct date of sale.

 

Warranty Part Repair Service

To request warranty service, contact Cubix Customer Service, or an authorized Cubix service provider. Cubix Customer Service will assist the customer in determining if a part needs to be replaced. If warranty service is required, Customer Service will issue a Return Authorization Number. Cubix will ship replacement parts to locations within the United States of America freight prepaid using a next business day delivery service. Although next business day delivery service will be used, Cubix cannot guarantee next business day delivery. Outside of the USA, Cubix will ship parts freight collect. All duties and customs charges are the responsibility of the customer.

Replacement parts orders will be shipped from Cubix Corporation by the end of the next business day after the order has been placed. Cubix will pay transport charges from Cubix to the customer site within the 50 United States.

The customer agrees to return the defective part to Cubix within 15 days from receipt of the replacement part. If the defective product is not returned to Cubix within the 15 day period, the customer will be invoiced for the replacement product and all associated transit charges. The product will be invoiced at the then current Cubix Retail List Price.

When returning the defective part, the customer is responsible for using adequate packaging, either the packaging included with the replacement part, or equivalent. The customer must prepay all shipping charges and insure the shipment, or accept the risk of loss or damage during transit. Cubix will not accept any freight collect or COD shipments. The customer must pay any duties, customs fees, taxes, or related costs.

This service is limited to defective parts only. This service does not cover exchanging entire systems. If the user with the assistance of Customer Service cannot ascertain the defective parts, the user should either obtain qualified on site service or return the system to Cubix for repair.

 

Exceptions to 3-Year Warranty

*IDE ATA drives sold as part of a Cubix system on or after 01-Oct-2002 are warranted for a period of 1 year.
